Reservation & Payment
Before you submit a reservation and deposit it is IMPERATIVE that you check with us the availability of the property for the dates required. After we have confirmed the requested property is available you must submit a reservation form and deposit so that we can confirm the reservation.
After a reservation has been accepted, you will receive a confirmation from us within 10 days. The confirmation will give details of the property, the owner/representative. Also, all the information regarding your stay.
The renter (person renting the property) certifies that he/she is over 18 years of age and is authorised to act on behalf of all persons who occupy the property during the period for which it has been booked and that they are all, except for infants, aware of the terms and conditions. No reservation will be accepted by Colby International unless we have received a completed reservation form together with a deposit and the terms and conditions agreed with.
The balance of the rental has to be paid 30 days before your arrival date. On receiving your full payment, you will receive a final confirmation indicating that you have paid in full. In the case where you make a reservation within 30 days prior to arrival, the full rental amount will be due upon making a reservation.
Attention: It is the renter’s responsibility to pay the rental balance by the due date. If we do not receive your final payment by the date indicated in your confirmation, your reservation will be cancelled without acknowledgment & we have the right to claim the remainder of the balance at any time.
The price given on the website is for the number of persons indicated in the description. The price includes all taxes. Our price includes (i) rental of property. (ii) utilities,ie: gas, electric, heat and air condition (iii) towels, bed linens, household linens. (iv) For a house, maintenance of the swimming pool & garden
Our price does not include: (i) telephone charges, (ii) heating of swimming pool/jacuzzi (iii) extra beds, baby cot, high chair for children, cleaning during the week, domestic pets, unless otherwise stated.
For some of our properties, a security deposit may be required on arrival by the owner/representative. You will be advised by Colby International. This security deposit has be paid in cash or cheque based on a bank in the country of the rental property or else occupancy can be refused by the person receiving you at the property. The security deposit will be refunded at a minimum of 30 days at the termination of tenancy (in some cases, you may be refunded upon your departure) less deduction of any breakages or damage.
Arrival & Departure dates
The renter must advise the owner/representative of their arrival time. Arrival & departure times will be stated in your confirmation and have to be observed. If you renter does not show at the property at the said arrival time, without informing the owner/representative you will lose the right of tenancy without recourse for reimbursement. In that case, the owner/representative has the right to re-rent the property. If, for any reason, the rentee leaves the property before the departure date contracted to, no refunds will be made for any remaining days. The renter must vacate the property by the time given in the confirmation. Failure to do so will incur a charge of one extra night.
Obligation of the Owner
The location & description of the property is as given to us by the owner who certifies that the property will also be presented to the tenant in good general condition for his arrival. The agency, Colby International is not responsible for any errors given to us by the owner. Colby International is not responsible in the case of any modifications made to the property or the environment not communicated to us by the owner at the time a reservation is made and the date of occupancy. Colby International’s responsibility is to act as an intermediary between the owner of the property & the renter. Our responsibility cannot be engaged by either rentor or rentee. The owner is totally responsible for the general condition of the property, safety and hygiene. It is the responsibility of the owner/representative to greet you on arrival or make alternative arrangements for you to receive the keys to the property.
Obligation of client/renter
The renter must behave in a good way and treat the property with respect. The renter will not throw parties, hold receptions without the consent of the owner. The property must be left in the same state as when found. If the owner has to use an extra cleaning team, he/she is allowed to use the security deposit for the cleaning fee. The number of people occupying the property cannot exceed that as stated on the reservation form unless prior arrangements have been made and extra beds cannot be used without authorisation. Tents, caravans or camper homes, invited people who are in infringement with the general law of the host country are strictly forbidden on any property at any time. The owner can evict the renter/tenants & terminate the contract without indemnity or compensation with immediate effect as well as keep the rental fee and the security deposit.
Description of the property
Most of the properties on our website have been visited at least one time by us. Our property descriptions are not exaggerated and if you find a property does not match the description given, Colby International in its capacity as an intermediary service cannot be responsible of any mistake (for dissimilation, omission, hidden defects) from the owner or the correspondent. Colby International which is acting as an intermediary cannot be responsible if some modification has been made that is detrimental to the property, environment or disponability and has not been reported to us prior to reservation date & your date of entry into the property. If the description states sateliite tv, this does not mean you will get channels in your native language
Equipment of the property
Your property will have utensils, furnishings, bed linens, towels, and kitchen equipment. The owner is responsible of the quality of the equipment which must correspond with the number of tenants (furnishings of garden & pool are not obliged to match number of tenants)
Capacity of tenenats
The property can only be rented to the number of people stated in the description. If you arrive with more than the agreed number of people you can be refused entry without reimbursement or allowed to stay for an extra fee asked for by the owner or representative.
If a tenant smokes in a property that does not allow smoking then they will be liable for any cleaning fees incurred to eradicate the smell of smoke. If they continue to smoke after a verbal warning has been given then the property owner has the right to evict the tenant & terminate the contract with loss of any monies paid for the remaining nights.
Domestic pets are not allowed unless where stated. They can only be accepted by prior arrangement with the owner. If not, the owner/representative can refuse their entry.
Cancellation & Responsibility
Cancellation by the renter: any cancellation must be received by us in writing, sent by registered post, requiring a signature on delivery. In the case of cancellation by you all monies paid are not refundable.
Cancellation by us: If we must cancel a reservation for such reasons as building maintenance, unforeseen circumstances, ie: death of owner, fire and force majeure you will be refunded
We accept no liability in respect of any loss or damage of any kind caused by wars, threat of war, terrorist attacks, natural disasters, acts of God, strikes, floods, fires, inclement weather conditions or any other event that constitutes “force majeure”
The use of amenities provided by the property owners such as swimming pool, jacuzzi etc, is entirely at the users risk and no responsibility can be accepted by the owner or Colby International in terms of death or injuries to persons or loss or damage to any belongings of the person who uses them
Colby International and its employees shall not be liable for any act, neglect or default of the property owner or any other person. Colby International will not be laible for any accident, damage, loss, injury, expenses or inconvenience whether to person or property which the renter or any other person may suffer arising out of or in any way connecting with the rental howsoever caused.
If you wish to make a complaint regarding the property you have rented you must talk to the owner/representative of the property immediately. If you are not satisfied, you must inform us by phone within 48 hours of your arrival. Your complaint must be followed by a registered letter with a signature on acceptance within 3 days of your arrival. After this time you will no have recourse for us to help you. These rules are here to protect you in the best way if you are not happy. For minor complaints we are always ready to be of service & to serve you as an intermediary with the owner. In the case of contest, the tribunal will be held in Liverpool, UK.
